Terms & Conditions

The Service simulates interview environments and requires the recording, processing, and storage of your microphone audio, webcam video, screen captures, keystrokes (where applicable), and behavioral signals (collectively, “Session Recordings”) during practice sessions, mock interviews, and HireVue-style modules.

By accepting these Terms, you give your express, informed, and revocable consent to:

• Capture of your voice, likeness, facial expressions, eye movements, posture, and spoken content via your device's camera and microphone for the duration of each session;
• Real-time and post-session transmission of Session Recordings to our servers and trusted third-party processors (including cloud infrastructure, speech-to-text providers, large language model providers, and computer-vision providers);
• Storage of Session Recordings and derived data (transcripts, embeddings, scores, metadata) for as long as your account is active and for a reasonable period thereafter for audit, dispute resolution, model quality assurance, and legal compliance, unless you request deletion as described below;
• Use of Session Recordings and derived data to generate feedback, scores, transcripts, summaries, and other product outputs delivered back to you.

You represent and warrant that you are the sole subject in each Session Recording, that you have authority to grant these rights, and that no third party (including other interviewees, colleagues, family members, or bystanders) is captured without their own consent. You are solely responsible for ensuring your recording environment complies with all applicable wiretap, two-party consent, and recording laws in your jurisdiction.

The Service uses automated systems, machine-learning models, and large language models (some operated by third parties such as OpenAI, Anthropic, Google, and similar providers) to evaluate your performance, generate scores, transcripts, feedback, and recommendations.

You acknowledge and agree that:

• All scores, ratings, rankings, percentile bands, strengths/weaknesses analyses, and qualitative feedback are inherently subjective, probabilistic, and may be inaccurate, incomplete, biased, or inconsistent across sessions and over time.
• Outputs do not represent professional advice, expert opinion, psychological assessment, employment screening, or any regulated evaluation, and should not be relied on as such.
• Models can “hallucinate,” misinterpret responses, misattribute statements, or produce content that is offensive or incorrect. We do not guarantee the accuracy, fairness, fitness, or completeness of any AI-generated output.
• Scoring methodology, rubrics, weights, and underlying models may change at any time without notice, and historical scores are not directly comparable across versions.
• You will not represent NextRound's scores as an objective measurement of your skill, competence, or employability to any third party (including employers, schools, or licensing bodies).

We process personal data, Session Recordings, and derived artifacts in accordance with our Privacy Policy. In addition to providing the Service, you grant us a worldwide, royalty-free, sublicensable license to:

• Use Session Recordings and derived data to operate, secure, debug, monitor, and improve the Service, including fine-tuning, evaluating, and benchmarking AI models;
• Create de-identified, aggregated, or anonymized datasets and statistics, which we may retain and use indefinitely for any lawful business purpose, including research, product development, marketing analytics, and disclosure to third parties;
• Share Session Recordings with subprocessors and infrastructure providers strictly as needed to deliver the Service.

You may request deletion of your personal data and Session Recordings at any time by contacting us; deletion requests will be honored within a commercially reasonable timeframe, subject to legal retention obligations and except for de-identified or aggregated data already produced.
